There is lots of discussion and in my opinion misinformation circulating about the common area at the Las Vegas Cay Club. In most condo complexes all of the common area is owned by the home owners association. In condo hotels it is very often the case that all of the common area is NOT owned by the home owners association. For example at The Signature at the MGM Grand, one of the few “True” condo hotels in Vegas, the HOA doesn’t own the bar, lobby, Starbucks or the pool area. The MGM Grand owns and operates this part of the property. Well that is exactly how the Las Vegas Cay Clubs was set up! If you click on the link at the top of this post you will see a sample of the legal description on every title report and you can very clearly see that there is an easement for this common area. Now there has been lots of discussion that Desert Tides may be able to limit this access but with this kind of language in the easement I doubt they would be successful in the long run.
I’m not an attorney so my understanding may be incorrect, I would recommend you make your own decision on this. I’m sure there will be a pack of attorneys racking up lots of billable hours to find out the answer!
